DMCA Policy

NCAA Gear Store operates as an independent online retailer providing premium, custom-printed phone cases. We take intellectual property rights very seriously and comply with the Digital Millennium Copyright Act (DMCA).

We contractually prohibit the sale of merchandise that infringes upon the intellectual property rights of third parties (including copyright, trademark, and related rights). If you believe that your intellectual property rights have been infringed by content on our service, please follow the procedure below.

A. Procedure for Reporting Infringement

It is the policy of NCAA Gear Store to: (1) Block access to or remove any content that it believes in good faith to infringe the intellectual property rights of third parties upon receipt of a compliant notice; and (2) Terminate service to repeat infringers.

To file a notice of infringement, please provide our Designated Agent with the following information:

  1. Identification of the copyrighted work or intellectual property claimed to have been infringed, including registration numbers if applicable.
  2. Identification of the infringing Content, including a description of where it is located on our website with sufficient detail (URLs) for us to verify its existence.
  3. Your full contact information: name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that the disputed use is not authorized by the rights holder, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf.
  6. An electronic or physical signature of the person authorized to act on behalf of the rights holder.

B. Action Upon Receipt of Notification

Once a proper, bona fide infringement notification is received, it is our policy to:

  • Remove or disable access to the allegedly infringing Content.
  • Notify the relevant party that the content has been removed.
  • Terminate access for repeat offenders.

C. Counter-Notice Procedure

If you believe the removed content is not infringing, you may send a counter-notice to our Designated Agent containing your contact information, identification of the removed material, a statement under penalty of perjury of your good faith belief that it was removed by mistake, and your consent to the jurisdiction of the Federal Court for the judicial district of South Carolina.
